ThiColor Terms of Service

Welcome to ThiColor (the "App"). These Terms of Service (the "Terms") constitute a legally binding agreement between you and Beijing Shuishan Shiliu Technology Co., Ltd. ("we", "us").

Please read these Terms carefully before using the App. By downloading, installing, or using the App, you confirm that you have read, understood, and agreed to be bound by these Terms in full. If you do not agree with any part of these Terms, please do not use the App.

1. Description of service

ThiColor is a color-recognition and recipe-solving tool for painters, illustrators, and art students. Its primary features include:

Picking colors from photos, the live camera, or a color wheel;
Outputting oil / acrylic / gouache pigment recipes via color-science algorithms (Kubelka-Munk + ΔE2000);
Saving and managing recipe "boards".

The App is intended as a color-mixing reference. The final result is affected by pigment brand, canvas, lighting, and other factors. Actual painting outcomes may differ from the App's output.

The App's core features work in signed-out mode (subject to the daily free quota).

To subscribe or sync across devices, please sign in with Sign in with Apple. We obtain your Apple user identifier and (on first authorization only) the name/email you optionally share. See the Privacy Policy for details.

You can sign out anytime from the "Mine" tab.

3. Free quota and subscription

3.1 Free quota

Non-subscribers can successfully pick 5 colors per calendar day. The quota resets at 00:00 device-local time.
Repeated picks of the same color + medium combination do not consume quota.
Historically saved recipes remain accessible after quota exhaustion.

3.2 ThiColor Member subscription

Subscribers receive:

Unlimited color picks and recipe solving
Unlimited saved recipes and boards
Cross-device sync (bound to your Apple ID)
Priority access to future content additions

3.3 Price and billing cycle

3.4 Auto-renewal (important)

This service is an Apple auto-renewing subscription.

24 hours before the end of the current period, Apple will automatically charge your payment method for the next period.
How to cancel: on your iOS device, go to Settings → Apple ID → Subscriptions, select "ThiColor Member", and turn off "Auto-Renewal". You must do this at least 24 hours before the current period ends, otherwise the next period will be charged.
After cancellation, your paid period remains usable until the end date.
Deleting the App does not cancel your subscription — you must cancel through the path above.

3.5 Refunds

All subscription refunds are handled directly by Apple; we have no authority to intervene.
To request a refund, visit https://reportaproblem.apple.com or submit via iOS Settings → Apple ID → Subscriptions → Request Refund.
Whether to approve a refund is at Apple's sole discretion.

3.6 Price changes

We may adjust subscription prices in the future. You will be notified via:

In-App prompt;
An email from the Apple App Store (Apple requires this for auto-renewing price increases).

You may accept the new price or cancel before the renewal.

4. Acceptable use

You agree not to use the App to:

Bypass subscription, quota, or other paywalls via jailbreak, cracking, reverse-engineering, or similar means;
Use the App's output for illegal, infringing, or socially unacceptable activities;
Transfer, share, or sell your subscription to a third party;
Interfere with the App's normal operation (e.g., transaction forgery, denial-of-service attacks).

Violation may result in immediate termination of service and may give rise to legal claims.

5. Intellectual property

5.1 Our rights

The App's source code, design, UI, brand, copy, algorithms (including but not limited to the pigment recipe solver), and bundled pigment data are the intellectual property of us or the respective rights holders. Without prior written permission, you may not copy, modify, distribute, reverse-engineer, or use them commercially.

5.2 Your content

Content you create in the App (such as saved recipes and names) belongs to you. We do not use, distribute, or publish your content in any form.

5.3 Trademarks

"ThiColor", "识色板", and related marks belong to us or the respective rights holders.

6. Disclaimers

6.1 For reference only

The color recipes provided by the App are algorithmic references and do not guarantee a specific painted result. Actual color outcome is affected by pigment brand, batch, canvas, lighting, and mixing method. For professional uses with strict color-accuracy requirements, please rely on physical test swatches.

6.2 Service availability

We will use reasonable efforts to keep the App stable but do not guarantee 7×24 uninterrupted availability. We are not liable for service interruption or data loss caused by iOS upgrades, Apple service issues, network failure, or force majeure.

6.3 Limitation of liability

To the maximum extent permitted by law, regardless of legal theory (contract, tort, or otherwise), we are not liable for any indirect, incidental, special, or punitive damages (including but not limited to lost profits, lost data, or lost goodwill) arising from your use of or inability to use the App.

Our total liability to you is capped at the total amount you paid for the App in the most recent 12 months.

7. Changes and termination

7.1 Service changes

We may modify, suspend, or discontinue all or part of the App's features based on legal requirements, technical evolution, or business changes. Material changes will be communicated via an in-App notice or version release notes.

7.2 Your right to terminate

You may stop using the App at any time. If you have an active subscription, please cancel it manually per Section 3.4.

7.3 Our right to terminate

If you violate these Terms, we may immediately terminate your access to the App, which may include account suspension. If we terminate your service during a paid period for cause, we will refund pro-rata the unused portion (via Apple's process).

8. Updates to these Terms

We may update these Terms based on legal requirements or business evolution. Notifications take the form of:

An in-App prompt;
App Store version release notes;
A change to the "Last updated" date at the top of this page.

Continued use after such updates constitutes acceptance. If you do not agree, please stop using the App.

9. Governing law and dispute resolution

These Terms are governed by the laws of the People's Republic of China (excluding Hong Kong, Macao, and Taiwan).
Any dispute arising out of or relating to these Terms shall first be resolved through friendly negotiation; failing that, either party may bring the dispute before the Chaoyang District People's Court of Beijing.

In the event of conflict between these Terms and Apple's standard subscription terms concerning subscription, billing, or refund rules, Apple's terms govern.
